Who has to file
Every company incorporated in the BVI, and every foreign company registered there, is within scope of the Economic Substance (Companies and Limited Partnerships) Act, 2018. The only question is how much you have to show, not whether you file.
A company that is tax resident elsewhere can claim that status in its return, but must provide evidence such as a tax residence certificate from that country.

Deadlines
The ES return is due within six months of the end of the company’s financial period. The annual financial return is due to the registered agent within nine months of the financial year end. Your government licence fee falls due separately, depending on incorporation date.
